PLEASE READ THIS DOCUMENT CAREFULLY! IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
The following terms and conditions govern the sale of products by Sohodiffusion.com. By submitting your online order to Sohodiffusion.com, you have indicated your acceptance to be bound by these terms and conditions of sale. At Sohodiffusion.com's sole discretion, these terms and conditions may be changed without prior notice at any time before Sohodiffusion.com accepts your order.

Policy



No refund, credit only (25% restocking fees)
Sohodiffusion.com allows the return of defective products for exchange or repair (according to manufacturer policy) within fifteen (15) days from the original invoice. Subject to a restocking fee, Sohodiffusion.com will allow the return of certain products for credit for any reason under certain terms and conditions.

The following procedures must be followed if you want to obtain a credit for a return item:
First, you must obtain a return authorization number (RMA). We are unable to accept returns without an RMA number.
Second, once you have obtained an RMA number, your purchase must be returned with shipping and insurance pre-paid in "as new" condition, in original box and packaging indicating the RMA number provided by Sohodiffusion.com, and including all warranty cards, manuals and accessories. Any variance from these conditions could result in delay or forfeiture of your credit. Returns for exchange will only be considered within 15 days from the original invoice date and are subject to approval and a 25% restocking fee. From and after fifteen (15) days from your original invoice date, we cannot accept returns of any product. All returns must be shipped prepaid. In all instances, original Shipping and Handling Charges are NOT refundable.
Some items, if opened, will not be covered by this return policy. Items not covered include opened software from any manufacturer and opened products of certain manufacturers subject to the manufacturers' return and warranty coverage.

THIS RETURN POLICY IS NOT A WARRANTY. Sohodiffusion.com reserves the right to change or to cancel it at any time before accepting your order. For all exchanges, you need to precisely follow the above return procedures to ensure the return of your exchange. You need to also allow a reasonable period of time for the product to arrive at our warehouse and pass an inspection process. When your return is accepted, we will process with the shipping of your new exchanged item as soon as possible.
Any returnable Product must be 100% complete, in BRAND NEW and unused condition. Sohodiffusion.com will not accept a return of any product that is not repacked in its original packing material and/or is missing any manufacturer supplied accessories or if there is obvious damage or visible wear and tear to the unit. We encourage you to insure your package for the full replacement value with your chosen carrier.

Return process



A. To obtain a "Return Merchandise Authorization"(RMA) Number, you must:

  • 1. Contact Sohodiffusion.com's RMA Service.
  • 2. Provide the invoice number, date of purchase, serial number of items to be returned, and reason for return.


Note: RMA numbers are valid for a period not exceeding the first of the two following dates: 15 days from the date of the original invoice or 15 days from the date of insuance. (5 days for laptops, monitors, and tablets)

B. Packing and Shipping

  • 1. Attaching a copy of the original invoice and test report of each item to be returned, if possible.
  • 2. Pack items in original shipping containers with all accessories, including manuals, cables, diskettes, etc.
  • 3. Mark the RMA number clearly on the outside of each container.
  • 4. Use Xpresspost (from Canada Post) or Purolator to obtain a tracking number and a delivery confirmation
  • 5. Ship to Sohodiffusion.com, freight prepaid and insured.


C. Replacement or repair will be made when merchandise is received by Sohodiffusion.com. No advance replacement is available.

D. Buyer shall pay the following miscellaneous charges:

  • 1. All items returned for credit: Restocking fee of 25%
  • 2. All items returned for exchange within 15 days: freight and insurance.


Disclaimers of warranties, conditions and representations

These terms and conditions may not be modified, altered or amended without the written agreement of Sohodiffusion.com. Any additional or altered terms attached or adhering to an order shall be null and void and without effect, unless agreed to in writing by Sohodiffusion.com.
You agree that the laws of the Province of Quebec and the laws of Canada applicable therein, without regard to conflicts of law provisions, will apply to all matters arising out of or in connection with this Website. You also agree to submit to the exclusive personal jurisdiction and venue of the courts of the Province of Quebec with respect to such matters. This Website can be accessed from jurisdictions whose laws may differ from those of the Province of Quebec. You agree that if you access this Website from another jurisdiction, you are responsible for compliance with local laws. Headings used in these Terms and Conditions are for convenience of reference only and are not intended to be part of, or to affect the meaning or interpretation of, these Terms and Conditions. If there is any inconsistency between this agreement and other agreement included with or relating to products purchased from Sohodiffusion.com, this agreement shall take precedence. If any provision of these terms and conditions is held to be illegal, invalid or unenforceable, in whole or in part, the legality, validity and enforceability of the remaining provisions shall not be affected or impaired. Sohodiffusion.com does not warrant that the contents of this Website are error-free. Sohodiffusion.com will use reasonable efforts to place accurate and up-to-date information on this Website, but makes no warranty of its accuracy, completeness, and/or currency. You may not assign this agreement without Sohodiffusion.com’s prior written consent. Sohodiffusion.com is the intended beneficiaries of this agreement.

Sales Conditions

Sales:
You may place an order on the website of Sohodiffusion.com by following the procedure indicated. Internet orders generate an automatic confirmation and response e-mail. Any online purchase is legally binding the buyer when the order is placed (when you click the Submit Order button). A restocking fee equal to 25% of the purchase price will be charged on any cancelled or refused order.

Pre-Orders:
Please be aware that while all pre-orders will be fulfilled, date of fulfillment is subject to stock on hand. Pre-orders are on a first come, first-served basis. Sohodiffusion.com cannot therefore guarantee shipping dates.

Online pricing and availability

Prices, specifications and availability of products are subject to change without notice. Due to the unpredictable nature of the computer market, descriptions may not reflect current technical information. Any typographical, photographic or specification error in products or pricing on our web sites is subject to correction. Internet orders generate an automatic confirmation and response e-mail. These automatic confirmations and response e-mails are subject to correction prior to shipment due to errors, changing market conditions, product discontinuation or unavailability, typographical errors, or any other reason. Our internet pages are an invitation for you to make us an offer to buy the items described; our shipment constitutes our acceptance of your offer. Sohodiffusion.com will notify you of any corrections or changes and ask for your approval before we complete your order. We will not complete your order until we have your approval. We reserve the right to limit sales, including the right to prohibit sales to resellers, even after we have received and confirmed your order. All orders placed over $5,000 (CA) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance program.

Purchasing by minors

For the protection of our shoppers, it is our policy to not sell to minors. However, if you are minors and wish to purchase from our web site, have a parent or legal guardian make the purchase for you. Thank you for your comprehension.

Limited warranty

When products are shipped to you, their limited warranties applicable to products are in effect and are included with the shipment. Certain products may have additional warranties provided by the original manufacturer but not by Sohodiffusion.com.Sohodiffusion.com warrants product(s) to be in good working condition and free from defects in material and workmanship for a period of fifteen (15) days from the original invoice (5 days for laptops, monitors, and tablets) date unless otherwise restricted below or by the manufacturer's own warranty policy. Sohodiffusion.com liability shall as limited to repairing or replacing, at its option, any defective product which is returned, freight prepaid to Sohodiffusion.com, according to the Merchandise Return Procedure set forth in Section Merchandise Return Procedure below. Buyer shall bear all responsibility for shipping charges and risk of loss or damage during transit to Sohodiffusion.com. Products which have been subjected to abuse, misuse, alteration, neglect or unauthorized repair or installation, as determined solely by Sohodiffusion.com, are not covered by this warranty. Any alterations, addition, improvements or attachments to the product(s) not authorized in writing by the Sohodiffusion.com shall be deemed to be a waiver of this warranty by Buyer and shall render this warranty null and void. Sohodiffusion.com shall return repaired or replaced product(s) to Buyer, at its expense via regular ground service within Canada. Shipping charges by all other methods and to all other destinations shall be borne by Buyer.

THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTY, EXPRESS OR IMPLIED. Sohodiffusion.com MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR OG MERCHANTABILITY. IN NO EVENT SHALL Sohodiffusion.com BE LIABLE FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES SUCH AS LOSS OF PROFITS OR BUSINESS OPPORTUNITIES, AND IN NO EVENT SHALL SOHODIFFUSION LIABILITY EXCEED THE PURCHASE PRICE OF THE PRODUCT(S).



Product Service Plan

The product service plan allows you, in situations where an item is defective after the first fifteen (15) days following the date of your purchase, to request that the item be exchanged or repaired simply by contacting our RMA department at the following address: RMA@sohodiffusion.com. You must follow the RMA procedure (Return Merchandise Authorization), indicating your invoice number and the description of the defective item. When you have subscribed to the product service plan, you must follow the same RMA procedure even after the fifteen (15) days following the date of purchase of your item.

After reception by Sohodiffusion.com of your defective item, we will undertake to do everything to satisfy you. For example, if you bought a video card at $ 278.90, and have subscribed to a one (1) year product service plan (for $19.99), we take care of sending your item to the manufacturer at our own expenses for repair or exchange. If the item cannot be repaired and is no longer available at the time, the item may be replaced free of charge with a new similar item (based upon availability), and we will send your new item at your home address free of charge.

It is important to note that the product service plan is subject to the following conditions. The product service plan does not cover damages resulting from the unsuitable or abusive use, or accidentals or induced damages. It does not cover items for which the serial number or warranty number has been modified or removed, items which have been modified without previous authorization from the manufacturer, and it does not extend over the normal life of the item either. This product service plan does not cover damages or malfunctions caused by fire, water, lightning, tentative repair, handling or shipping.

Arbitration

All dispute, controversy, or claim against Sohodiffusion.com arising out of or relating to these Terms and Conditions, their interpretation, or the breach, termination or validity thereof, or any related purchase shall be resolved by first submitting a solution to Sohodiffusion.com.

Limitation of liability

The maximum liability to you for products purchased from Sohodiffusion.com shall be limited to the purchase price you have paid for the products. Also Sohodiffusion.com will not be liable for any property damage, personal injury, loss of use, interruption of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages. This applies to all situations however caused, whether for breach of warranty, contract, tort (including negligence), and strict liability or otherwise, other than those damages that are incapable of limitation, exclusion or restriction under applicable law.
